is that action definitely still ongoing? the threat of legal action is in itself pretty serious. if a company with lots of lawyers and money behind it threatens legal action on somebody who does not have the same back up then they either have to hire their own legal team at their own personal expense (and risk loosing the case) or meekly do whatever the other shower are demanding. it'd probably be counter productive, and bad publicity, to bring a case against a little guy when you've already beaten them

A large successful company having a coniption when the little guy throws some criticism their way...It has shades of the McLibel Trial about it.

this reminds me of the bad psychology behind a witch trial. people not really knowing the full story or actual facts/outcomes of the very genesis of this policy! but sure here, we'll get fucked in the ass so badly we'll lose our house if we say anything. so... mcd achieves exactly what it set out to. fear wins. mcd wins.

if a case came up, they could afford to keep it in court alot longer than Pete due their all their excessive booking charges. and thumped would be up the shitter. ive said too much. that is all.

believe me, mcd cares a lot more about people being scared shitless to speak out against them than it does about revenue generated through advertising on thumped. mcd has achieved exactly what it set out to.

reminds me of what a dude was saying a while back, that the internets is still in a very early stage of development, like wild west america or something... everyone approaches it with their own morals rather than there being an overruling board of internet to stop weird shit happening. thats why loads of the internet is basically made of porn and violence, acres of advertising and miles of venting 2D bile, and with no quality control whatsoever.. 'freedom of speech' is not in the constitution of the internet, as there isnt one, and probably wont be for quite a few years, i would say its small beans in terms how bad things could get if you left the tap running.

Alot of people don't seem to understand what freedom of speech means. Everyone here has freedom of speech. They can print a pamphlet, start their own website on their own servers, talk to people on streetcorners etc freely but that doesn't give them the right to say what they want all the time online, ie because this is Pete's site he can say what is allowed and not allowed. Because The Irish Times doesn't print my letter that doesn't mean my right to freedom of speech has been infringed. The controllers of that media outlet have made an editorial decision. In a sense Pete has made an editorial decision. If you have a problem with that there are alternative message boards or you could head on over to proboards and start your own messageboard. Having said that, it is a pain in the arse when you want to talk about a band that you know others here will like and can't.

i was going to do a multi quote response but i'm too lazy, so to summarise:

- MCD vs boards.ie is still ongoing, as far as I know. Probably won't actually reach court for ages yet though. I'm trying to contact someone who might know.

- While as far as I know there's no legislation or case law dealing with online libel / defamation here yet, have a read up on what happened with the 'ratemysolicitor.com' High Court action last year.

- Yes, the ban is about self preservation and a denial of free publicity, but it's also about the passive-aggressive satisfaction of sending someone to coventry. And it's a small act of solidarity with boards.ie too - I thought last year that more people would do likewise, but there you go.

I find it pretty bizarre that this actually merits a discussion. Pete's decision is about as logical as things get. And making Dudley out to be the bad guy is fucking ludicrous.

yeah. I agree with Pete's decision, but at the same time.. there is this element to it. so what are we to do? - set up a promotion company, pump a tonne of cash into it and then crush them? I could live with that.

I hate their guts, but I still go to gigs they promote. In lots of ways that offends me.
 
Isn't the whole point not to get one over on MCD but to prevent Thumped(Pete) getting the same legal threats as Boards.ie?
 
double tripple nipple. yous are all gay. especially vinny. poor mcd, they must be really anxious about the whole thing. i love pete and everything he stands for however, that has never changed. he is 100% saintly and awesome.
