Tell it not to sync in the main Ipod window in itunes and you should be able to. this works for me

Just to say generally, is it not a horrible feature that you can't have your data back if you lose your old computer or your HD crashes?
I mean, you data is right there on your iPod, but Apple says you can't have it.

They don't allow it at all to prevent people from going over to a friends house, pretending to iTunes that it's a new computer and then just copying all their music onto their mates PC.
