TANAISTE Michael McDowell was last night engulfed in a new underage legal crisis after admitting he scrapped the law banning the soliciting of children for sex.
The embarrassing blunder by the Justice Minister - who admitted he had been completely unaware of the omission - came as a civil servant was suspended from his job as a result of the investigation into an alleged paedophile ring.
The official at the Chief State Solicitor's Office was interviewed by gardai investigating a series of sex assaults on a teenage boy.
Gardai are satisfied the 15-year-old at the centre of the investigation was assaulted at least three times.
At the same time, the debacle of last summer's underage sex law crisis was reignited as Mr McDowell conceded yesterday he will have to close a legal loophole as soon as possible.
He was also under pressure to speed up new laws to prevent the so-called grooming of children by sexual predators. This clampdown was promised by the Government last July and is still being drafted in the Attorney General's office.
Labour highlighted the soliciting loophole yesterday as it pointed out that, until a year ago, it was an offence to 'solicit or importune' a child for sexual purposes.
Its leader Pat Rabbitte accused the Government of a 'grievous omission' and an 'astonishing oversight'.
He said the offence had been inadvertently removed in the emergency legislation brought in by Mr McDowell in response to the C case crisis.
Embarrassed yet again in his handling of such laws, Mr McDowell attempted to play down the significance of the error saying it was only a minor offence.
His officials also insisted the charge would not apply in the current abuse investigation.
Mr McDowell described the status of the controversial omission as being a "minor offence".
He said it could only be brought in the District Court and no convictions had been recorded in Garda annual reports for the last five years under this offence, he said.
But Mr Rabbitte said the minister was admitting the anomaly had been created and emergency legislation was needed to close it. "For soliciting there is now no offence. I don't think the parents of Ireland will regard this as a minor offence." He added: "It most definitely is not."
Mr McDowell said the public needed to be aware that the gardai have "a wealth of indictable offences at their disposal" to fully investigate the activities of paedophile rings and to prosecute any person attempting to prey sexually on young children. "In relation to the minor District Court offence under section 6 of the 1993 Act, I thank Deputy Rabbitte for pointing out the anomaly and it is my intention at the earliest available opportunity to reapply its provisions to sexual offences against children," he said.

also, i hate the way some news stories follow a procedure of reporting things like this:

i think the green party when it came to the act that was put together in 3 minutes, and considering how falwed it was most of those 3 minutes were spent drinking coffee, warned that about how rushing the bill throw without proper consideration would cause problems down the line

they were right
