The main defences to defamation are Justification (truth), Privilege, Fair Comment and Apology.
Justification – has already been mentioned as an absolute defence, but where it fails exemplary damages may be awarded.
Privilege – is absolute or qualified: absolute privilege is limited by policy to statements in the Oireachtas and the Courts and other special cases. Qualified privilege is the defence normally applicable to architects or other professional persons who are required to make potentially defamatory statements where there is a moral, professional or social justification for doing so: however the statement must go beyond what was reasonably
necessary to discharge that obligation.
Fair Comment – is where the statement is made on a matter of public interest and the defamation was an incidental attribute of the expression of an opinion on that matter which was fair in that it was honest. In this the law recognises the necessity to free criticism in matters of art and public affairs.
Apology – is not strictly a defence by virtue of Section 17 of the Act an apology before action, or as soon as possible, is allowed in mitigation of damages.
