ISPs providing addresses of p2p users to the IRMA? (2 Viewers)

The Register said:
After weeks of silence on the issue, the Internet Service Providers in Ireland (ISPAI) released a statement of position saying they're under no legal obligation to follow IRMA's orders.

Privacy of user communications is protected in European and Irish legislation. ISPs can not be expected to ignore these merely because it does not suit another private party. To do so would breach the privacy of our users as well as having serious implications for the continued location of international e-business in this country and the jobs these generate.

According to ISPAI's website the org's members include BT Ireland, O2, Verizon Ireland, Vodafone, Clearwire, Google Ireland, UPC Ireland, and...Eircom. The letter states the ISPAI board of directors and general manager consulted with its members, who voted on a majority basis to approve the position statement.

look at the way the Isle of Man decided to handle the problem compared to Ireland!

http://www.guardian.co.uk/music/2009/jan/20/isle-of-man-unlimited-downloads

far more progressive.

yes that makes a bit more sense - I wonder what the upshot would be in a bigger place like the UK or whatever though?

Time to find out
Virgin and Universal have signed a deal that will give the ISP's customers access to "unlimited" music.
For a monthly fee, Virgin's broadband customers will be able to download or stream as many MP3 files as they want.
Those signing up will be able to put the tracks on any music player and keep the music they have downloaded even if they stop paying the monthly fee.

Hmm, it would seem that the main point about this is not so much that you can get as much music as you want. It's that Virgin will cut you off if you file share. See this blog:

http://www.bbc.co.uk/blogs/technology/2009/06/piracy_did_someone_blink.html

that blog said:
...my first reaction was that this was interesting, but far from ground-breaking. After all, there are other "all you can eat" music subscription services...

...by promising "a temporary suspension of internet access" for persistent offenders, Virgin appears to have gone further than any other ISP in acceding to the demands of the music industry.

Aye, nobody comes off well in that exchange. Also it's a little ridiculous when your designated IMRO spokesman is also the head of Aslan's record label. I mean the chances of Aslan & Willie Kavanagh disagreeing on any point were slim to none.

Jesus that's mad.

Pat conflating patents and copyright
The mad analogy between between class A drugs and filesharing (yer man from Aslan was quiet during that bit!)
The guy from IRMA with his fake outrage and his head up his arse
The squeaky voiced nerd

Mad and depressing.

I'd expect an industry hack to have that sort of attitude on filesharing - I guess when his job depends on not understanding something......

But it's unusual in this day and age to hear a band who's attitude to filesharing is that un-nuanced

sure people just stream stuff and share hard disks these days anyway, no one downloads

yeah, I know people download stuff, I downloaded an album myself today. But streaming seems to be the way a lot of it is going. Spotify seems quite big, there's also Imeem.

But hard disk sharing is what a lot of people I know do for tv shows, films etc. Only one person has to download it or buy it in a group of 20-30 people and it makes its way around quite quick

IMRO and IRMA are two different bodies!

IRMA = record companies
IMRO = songwriters.

I've just been listening to the first minute or two of this and have done a mere 10 minutes of googling to try verify the claim of 25,000 downloads. The EMI press statement mentioned that they've tracked that amount of downloads "through Torrents Nova and Pirate Bay alone." The first problem with that is that there's no such site as Torrents Nova (I presumed they meant mininova but Aslan gets zero hits over there) but never mind, we'll carry on.

Next I search for ever possible permutation for downloads of the new Aslan album and I kept getting the same result which is "Aslan - Uncase'd (2009) KompletlyWyred Dhz.inc" which was uploaded to thepiratebay. However this file only has a grand total of 9 seeders and 6 leechers and has been alive since the 26th of June. There's no way of telling how many times it's been leeched exactly but even if it was 6 new leechers every day it'd be a total of 108 downloads. It is fair to assume that only 9 of these bothered to seed back so I'd say the total is right.

Wondering still where the hell they got their mystical 25,000 total from I just searched for "Aslan Uncased" and was surprised to see 5 links to torrents of the album in the first two pages of results. However 4 of the 5 just link back to the one on TPB with 9 seeders. The 5th is where I think they got their mystical 25,000 total from:

http://www.nowtorrents.com/torrents/aslan-uncased.html

This is the 7th result you get on google for the album title and when you click it you actually get "No Matches were found" but up at the top are FAKE results that are actually just ad links. You could search for anything and you'll get those exact same four ad results.

If you refresh the totals change each time so it's safe to say they found this link by googling the name, added up the total of listed downloads they got (which is totally random) and are using that to moan about their loss of sales. Incredible.
